1. Acceptance of the terms
By creating an account or using 961.menu as a merchant, customer, or partner, you agree to these terms as well as the Privacy Policy, Acceptable Use Policy, and any additional agreement that applies to your role (including the Merchant Agreement or Partner Agreement).
2. What 961.menu is (and is not)
961.menu is a commerce platform that provides merchants with online-ordering tools, digital menus, and order coordination through WhatsApp.
**961.menu is not:**
• A delivery platform with its own delivery fleet
• An agent that accepts orders on behalf of the merchant
• A party to the transaction between merchant and customer unless explicitly stated otherwise
3. Merchant accounts
• The merchant is responsible for providing accurate business information and completing required verification before the store page goes live
• The merchant is responsible for the accuracy of the menu, prices, and product information
• The merchant is responsible for fulfilling orders received through the store page
4. Customer use
Customers use the store page to browse the menu and start an order. The final transaction occurs directly between the customer and the merchant. Currently, 961.menu does not process customer-order payments; payment takes place directly between customer and merchant, in cash or by a method the merchant provides.
5. Fees and billing
Monthly/annual subscription pricing and any additional fees are shown on the official plans page. Billing is handled through Whish or manual activation depending on the case. For questions about billing cycles or refund policy, contact us directly before subscribing.
6. Prohibited use
Prohibited use is governed in detail by the Acceptable Use Policy. Violations may lead to account suspension.
7. Intellectual property
The merchant retains ownership of its brand, content, and menu data. 961.menu retains ownership of the platform and its underlying technology.
8. Termination
Either party (the merchant or 961.menu) may end the relationship. Exact details such as notice period and post-termination data handling are still under final legal review.
9. Limitation of liability
This clause is under final legal review, particularly regarding order fulfillment, delivery arrangements that occur outside the platform, and WhatsApp outages (external infrastructure not controlled by us).
10. Governing law
Lebanon is expected to be the governing law for these terms, subject to final confirmation through legal review.
11. Changes to these terms
We may update these terms from time to time. Continued use of the platform after an update constitutes acceptance. We will provide advance notice of material changes where reasonably possible.
